...má pôvod v prehistórii. Išlo o magický úkon respektíve náboženský obrad, pri ktorom dochádzalo k deflorácii panny čarodejníkom (kňazom).

"Ius primae noctis" (právo prvej noci) bol pôvodne defloračný obrad panny kmeňovým čarodejníkom. V primitívnych spoločnostiach sa totiž defloračná, menštruačná a popôrodná krv považovala za nebezpečnú - verilo sa, že súvisí so zlými silami. Bolo to účinné a pôvodné "pohanské vykupovanie sa" postupne získalo rozličné označenia: hanebný groš, panenská daň a podobne. "Panenský poplatok" hradil ženích príslušnej vrchnosti a prostredníctvom tejto úhrady si pre seba vlastne zabezpečil právo prvej noci.
